| 概要 | 特定領域研究「法化社会における紛争処理と民事司法」は，民事紛争過程を分割し，問題経験から紛争の発生までの段階に焦点を合わせる「紛争行動調査」，問題処理のための相談行動の段階に焦点を合わせる「法使用行動調査（相談行動調査）」，および，訴訟提起後の訴訟遂行行動の段階に焦点を合わせる「訴訟行動調査」の3つの全国調査を実施することにより，民事紛争過程の全体を把握することを目指した。 本調査はこのうちの「訴訟行動調査」である。「紛争行動調査」は調査番号1039，「法使用行動調査（相談行動調査）」は調査番号1040でそれぞれ公開されている。 本調査は「民事訴訟全国調査・訴訟記録調査」「全国民事訴訟当事者調査・代理人調査」「全国民事訴訟一般人調査」「インターネット調査」の4つの調査から構成されている。 なお「全国民事訴訟当事者調査・代理人調査」のうち，当事者調査は「代理人付原告」「代理人付被告」「本人訴訟原告」「本人訴訟被告」の4種類の調査票からなり，代理人調査は「原告側代理人」「被告側代理人」の2種類の調査票からなる。 また「全国民事訴訟一般人調査」では，当事者調査と同じく単に「裁判」という言葉を用いた調査票（一般A）と，「民事裁判」という言葉を用いた調査票（一般B）の2種類を用いた。 また「インターネット調査」は12種類の調査票を用いた。 With the objective of understanding the entire process of a civil dispute, the specially promoted research on “Dispute Resolution and Civil Justice in the Legalizing Society” divided the process into three sub-processes and conducted one national survey for each. The three surveys were the “Disputing Behavior Survey,” which focused on the stage between the problem and the dispute, the “Legal Advice Seeking Behavior Survey,” which focused on the stage of legal advice-seeking behavior for problem-solving, and the “Litigation Behavior Survey,” which focused on the stage of litigation behavior after the lawsuit is filed. This is the “Litigation Behavior Survey.” The “Disputing Behavior Survey” and the “Legal Advice Seeking Behavior” were published under survey numbers 1039 and 1040 respectively. This survey is the combination of four surveys: “Civil Litigation National Survey/Case Record Survey,” “Nationwide Civil Litigation Parties and Their Lawyers Survey,” “Nationwide Civil Litigation General Public Survey,” and “Internet Survey.” The party survey in the “Nationwide Civil Litigation Parties and Their Lawyers” comprises four types of questionnaires: “Plaintiff with a lawyer,” “Defendant with a lawyer,” “Self-represented plaintiff,” and “Self-represented defendant.” The lawyer survey comprises two types of questionnaires: “Plaintiff’s lawyer” and “Defendant’s lawyer.” Further, in the “Nationwide civil litigation General Public Survey,” two types of questionnaires are used: General A, which uses the simple term “Trial,” as does the party survey, and General B, which uses the term “Civil Trial.” The “Internet Survey” uses twelve types of questionnaires. |
